Dykema would like to remind U.S. employers that they must use the October 21, 2019, version of the I-9 Employment Eligibility Verification form beginning May 1, 2020. Since January 31, 2020, employers were allowed to use either the July 17, 2017, or October 21, 2019, version of the form. These dates are indicated in mm/dd/yy format in its bottom left corner. The Form I-9 is used to confirm the identity and employment authorization of people hired as employees by U.S. employers.

This new version includes additional countries in the Country of Issuance field in Section 1 and makes changes that can only be seen in the forms electronic format. These include:
Information on those who can be an authorized representative of the employer;
Updated information regarding what documents are acceptable to complete the form;
Confirmation that filing non-applicable fields in the columns regarding identity documents with “N/A” is not required; and

Confirmation that List C documents (which confirm U.S. employment authorization) do not include Employment Authorization Documents (EADs) that include a photo of the person. (List A documents confirm identity and employment authorization while List B documents confirm only identity.)
